Learning Support Services Office is here to help you
navigate special education, student registration and
other aspects of student services.
The NYS Education Department's Office
of Special Education has initiated a Special Education
Quality Assurance [SEQA] Special Education Programs and
Services Focused Review in the Hilton Central School
District during the 2011-12 school year. The purpose
of of this review is to assess the district's compliance
with selected federal and State laws and regulations
governing the education of students with disabilities.
The review will be conducted by the SEQA Western Regional
Office and will include representatives from the school
district. The review process will involve a review of school
records of selected students with disabilities, classroom
visitation and interviews. In addition, meetings of
the committee on special education will be observed.

Learning Support Services is responsible for the
evaluation, placement and service provision of and
for students with disabilities as defined by the
Part 200 of the Commissioner's Regulations and IDEA
[Individuals with Disabilities Education Act] which
mandates a free and appropriate education in the
least restrictive environment. Preschool
evaluations, English as a Second Language services,
tutoring services, health-related services, foster
care placements, social worker services,
psychological services, speech and language
services, occupational therapy, physical therapy,
extended school day and extended school year
programs are governed and coordinated through the
LSS Office. The Office develops Individualized
Education Plans [IEP] for students identified with
special education services. The process is
governed by State and Federal law and regulation
including Sect. 504 of the ADA [Americans with
Disabilities Act] which protects the rights of
individuals with disabilities in programs and
activities which receive federal funds from the US
Dept. of Education. For further

Parent[s] of the student; regular education teacher of the
student whenever the student is or may be participating in
the regular education environment; special education teacher
of the student, or if appropriate, special education
provider of the student; school district representative who
is qualified to provide or supervise special education and
is knowledgeable about the general curriculum and the
availability of resources of the school district [this
person may also be the special education teacher/provider or
school psychologist]; an individual who understands and can
talk about the evaluation results and how these results
affect instruction [this person may also be the special
education teacher/provider, regular education teacher,
school psychologist, school district. representative or
someone that the school district determines has knowledge or
special expertise regarding the student]; school psychologist; school
physician [upon request]; parent member
[unless the parent requests that the parent member not
participate)]; other people that have knowledge or special
expertise regarding the student, including related services
personnel as appropriate [as requested by the parent or
school district]; the student, if appropriate. For further

Committee on Preschool Special Education:

the child or, if appropriate, special education provider of
the child; School district representative who is qualified
to provide or supervise special education and is
knowledgeable about the general curriculum and the
availability of preschool special education programs and
services and other resources of the school district and the
municipality [this person is the chairperson of the
committee]; an individual who understands and can talk about
the evaluation results and how these results effect
instruction [this person may also be the special education
teacher/provider, regular education teacher, school
psychologist, school district representative or someone that
the school district determines has knowledge or special
expertise regarding the student]; parent member [unless the
parent requests that the parent member not participate]; a
licensed or certified professional from the Department of
Health’s Early Intervention Program [for a child in
transition from the Early Intervention Program]; other
people that have knowledge or special expertise regarding
the child, including related services personnel as
appropriate [as requested by the parent or school district];
a county representative [a certified or licensed preschool
representative from the municipality must be notified of
scheduled meetings; however the CPSE meeting can be held
whether or not the municipal representative attends]. For

School Physicals in New York State
are required. Physical examinations must be completed in
grades K, 2, 4, 7 and 10 as well as new entrants to the

HEALTH APPRAISAL FORM
Student Records
Family
Educational Rights and Privacy Act [FERPA] affords
parents and students over 18 certain rights with respect to
the students educational records. For further information
from the US. Dept. of Education:

Health Information Portability and
Accountability Act [ HIPAA] - HIPAA
does affect the nature of the exchange of information
from the student’s health care provider TO the school.
Previous informal exchanges between health providers and
school health staff are no longer permitted;
explicit written authorization is required from the
parent or guardian in order for information to flow to the
school. For example, immunization records require such
authorization. HIPAA a federal law that imposes new
standards for the protection of individual health
information. It is important to distinguish between HIPAA
and FERPA (the Family Educational Rights and Privacy Act).
Educational records that are subject to FERPA are expressly
exempted from HIPAA’s coverage. Therefore, the
confidentiality and privacy of school health records that
are part of the student’s educational record are governed
solely by FERPA. The passage of HIPAA does NOT change that
in any way. HIPAA does, however, affect the nature of the
exchange of information from the student’s health care
provider TO the school. Previous informal exchanges
between health providers and school health staff are no
longer permitted; explicit written authorization is required
from the parent or guardian in order for information to flow
to the school. For example, immunization records
require such authorization. Within the school setting, FERPA
continues to govern the exchange of health care information
that is contained in the student’s educational record. It is
not necessary to obtain a release of information from a
parent or guardian in order to share such information with
school staff for the purposes of insuring the best and most
appropriate care for a student. For additional information,
